General terms and conditions

I. Area of application, conclusion of contract

The Tourismusverband Osttirol (East Tyrol tourist board) enters into the business relationship with the booking party as an agent. A booking contract will then be concluded between the booking party and the accommodation establishment. The following general terms and conditions apply to this contract in their form as valid when the booking is placed.

Any reciprocal claims arising from this contract can only be asserted against a direct partner to the contract and the Tourismusverband Osttirol is free from any liability or joint liability.

Unless otherwise stated by the host, the following cancellation conditions apply:

II. Extract from the Austria Hotel Contract Conditions 2006 on the 'Withdrawal from a contract of accommodation - cancellation fee':

5.1 If payment of a deposit is required as part of the accommodation contract and this deposit is not paid by the contract partner within the agreed date, the accommodation establishment can withdraw from the accommodation contract without notice.

5.4. Up to 3 months before the agreed arrival date of the contract partner, the accommodation establishment can cancel the accommodation contract for a justifiable reason by informing the contract partner of this fact, unless agreed otherwise.

5.5 Up to 3 months before the agreed arrival date of the guest, the contract partner can cancel the accommodation contract by informing the accommodation establishment of this without a cancellation fee being incurred.

5.6 Different cancellation fees: A withdrawal from the contract by the contract partner at any point after the time specified under point 5.5 will incur the following cancellation fees:

• Up to 1 month before the arrival date, 40 % of the full package price
• Up to 1 week before the arrival date 70 % of the full package price
• During the last week before the arrival date, 90 % of the full package price

III. Additional general terms and conditions

1. No additional agreements have been made.

2. Modifications and additions to this contract must be made in writing in order to be legally valid. If the property has its own terms and conditions for cancellation and payment at the time of booking, these will apply.

3. The accommodation establishment expressly confirms that the Austrian Hotel Contract Conditions 2006 are valid for all agencies.

4. The Tourismusverband Osttirol guarantees that customer details will only be acquired, processed and stored in relation to travel agency processes.

5. No responsibility is taken for the accuracy of the image material provided by the accommodation establishment.
